IMPORTANT:
These Terms and Conditions govern the relationship between pagaleads.com and licensed California law firms and attorneys ("Participating Law Firms") who purchase lead generation services.
By accessing our Platform, registering an account, or receiving leads from pagaleads.com, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.
If you do not agree, do not use our Services.
California SB 37 Notice (Effective January 1, 2026):
California Senate Bill 37 significantly reshapes legal advertising and lead generation in California.
These Terms incorporate SB 37 compliance obligations for both pagaleads.com and all Participating Law Firms.
Non-compliance with SB 37 may expose violators to statutory damages of $5,000 to $100,000 per violation.
Both parties acknowledge their independent obligations under SB 37 as set out in Section 6 of these Terms.
1. ACCEPTANCE OF TERMS
These Terms and Conditions ("Terms") govern your access to and use of the website www.pagaleads.com (the "Site") and all services provided by pagaleads.com ("pagaleads," "we," "us," or "our").
By accessing or using our Services, you represent and warrant that:
• You are at least 18 years of age and have the legal capacity to enter into a binding contract
• You are a licensed California attorney or an authorised representative of a law firm licensed to practise law in the State of California
• You have the authority to bind your firm or organisation to these Terms
• Your firm maintains all licences, registrations, and authorisations required to practise employment law, personal injury law, or PAGA representative actions in California
• You have read and understood all compliance obligations set out in these Terms, including those arising under California SB 37, the TCPA, the CCPA, and the California Rules of Professional Conduct
If you are using the Services on behalf of a law firm or organisation, you represent that you have full authority to bind that entity to these Terms.
2. DESCRIPTION OF SERVICES
pagaleads.com is a California-focused specialist lead generation service. We generate, qualify, and deliver exclusive inbound leads from individuals who have self-reported a potential California legal claim across the following verticals:
• PAGA Wage Claim Leads: California workers who report personally experiencing wage violations qualifying under the Private Attorneys General Act (Labor Code §2698 et seq.), including meal and rest break violations, off-the-clock work, timecard rounding, unpaid overtime, wage statement violations, and related claims, consistent with post-2024 PAGA reform standing requirements
• Employment Law Leads: California workers who report experiencing potential workplace violations including discrimination (race, gender, age, disability, national origin, religion, pregnancy), wrongful termination, sexual harassment, hostile work environment, whistleblower retaliation, FMLA/CFRA violations, and constructive dismissal
• Slip and Fall Personal Injury Leads: California residents who report sustaining injuries on third-party premises within the applicable statute of limitations, who have confirmed the incident location and sought or intend to seek medical treatment
Our Services include:
• Generation of exclusive, inbound leads through compliant digital advertising campaigns
• Lead qualification through structured intake funnels designed to filter for qualifying criteria
• TCPA-compliant consent documentation via TrustedForm certificate capture on every submission
• Real-time lead delivery via webhook, API, email, or CRM integration
• TrustedForm certificate URL delivery with every lead record
• Account management and compliance support
Paga Leads (pagaleads.com) is a lead generation service only.
We are not a law firm, do not provide legal advice, do not constitute a lawyer referral service as defined under California Business & Professions Code §6155, and do not create any attorney-client relationship between any individual and any Participating Law Firm.
3. LEAD DELIVERY, QUALITY, AND DISCLAIMER
A. Real-Time Delivery
Leads are delivered in real time at the moment of submission via your nominated delivery method (webhook, API, email, or CRM integration). pagaleads.com aims to ensure delivery within 60 seconds of form submission. You are responsible for maintaining a functional receiving system capable of accepting real-time lead delivery.
B. Exclusivity Commitment
Each lead generated through our Platform is delivered exclusively to one Participating Law Firm. pagaleads.com does not resell, recycle, redistribute, or repackage leads to multiple buyers. If you believe a lead was delivered to another firm in error, contact [email protected] within 48 hours for investigation and resolution.
C. Lead Quality Standards
pagaleads.com implements the following qualification measures on all leads prior to delivery:
• Identity verification: name, phone number, and email address captured and validated at point of submission
• Geographic verification: confirmation that the claimant is located in or the incident occurred in California
• Statute of limitations verification: confirmation that the relevant event occurred within the applicable California limitations period
• Qualification questions: structured intake questions designed to filter for claims meeting the threshold criteria for each lead vertical
• TCPA consent capture: TrustedForm certificate generated at point of every submission documenting prior express written consent
• Bot and fraud detection: TrustedForm bot detection and IP validation applied to submissions
PAGA Leads specifically: every PAGA lead is qualified to confirm the individual has personally experienced a qualifying wage violation, consistent with the post-2024 PAGA reform requirement that the filing party be an aggrieved employee who personally suffered the violation (Labor Code §2699(a)).
D. No Guarantees
While we implement rigorous qualification processes, pagaleads.com makes no guarantees regarding:
• Lead conversion rates or contact rates
• Whether any individual will ultimately qualify for legal representation
• Whether any claim will succeed or result in a settlement or judgment
• Specific case outcomes, settlement amounts, or attorney fee recovery
• Lead volume or ongoing availability in any given period
• Revenue, income, or profit results for Participating Law Firms
Lead performance depends on numerous factors outside our control including your intake process, contact speed, sales process, attorney-client fit, case facts, and applicable law at the time of any claim.
E. Initial Order Cap and Eligibility
Initial orders are capped at 10 leads to allow both parties to establish quality benchmarks and confirm fit. Once a working relationship is established, subsequent orders carry a 25-lead minimum. pagaleads.com works exclusively with established plaintiff-side law firms with dedicated intake teams and proven conversion processes. This service is not designed for solo practitioners or single-person operations.
4. CLIENT RESPONSIBILITIES
As a Participating Law Firm, you agree to:
Intake and Response:
• Maintain a functional CRM, intake system, or lead management platform (eg. Google Sheets) capable of receiving real-time webhook or API lead delivery
• Contact leads promptly upon delivery — we strongly recommend initial contact within 5 minutes of receipt, as contact and conversion rates decline significantly with delay
• Designate a dedicated intake coordinator or team responsible for following up on pagaleads.com leads
Legal Compliance:
• Comply with all applicable laws governing attorney conduct, advertising, and client solicitation, including the California Rules of Professional Conduct Rules 7.1 through 7.3
• Comply with California Senate Bill 37 (effective January 1, 2026) including all attorney advertising identification and disclosure requirements — see Section 6
• Comply with the Telephone Consumer Protection Act (TCPA), including obtaining or verifying prior express written consent before contacting any lead by automated means, prerecorded message, or SMS
• Retain the TrustedForm certificate URL delivered with each lead as part of your TCPA compliance records for a minimum of 5 years
• Honour all consumer consent revocation and Do Not Contact requests within 10 business days in accordance with the April 2025 FCC revocation requirements
• Maintain an internal Do Not Call list for a minimum of 10 years in accordance with California requirements
• Comply with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) in connection with all personal information received from pagaleads.com
• Comply with all applicable California State Bar rules, including rules governing fee agreements, client communication, and conflicts of interest
Data Use and Confidentiality:
• Use leads solely for the purpose of evaluating and potentially representing the individual in connection with their disclosed legal matter
• Not resell, redistribute, transfer, or share any lead data with third parties outside your firm without our prior written consent
• Treat all personal information received from pagaleads.com as confidential and implement appropriate technical and organisational security measures to protect it
• Not use lead data for any purpose unrelated to the legal matter disclosed by the individual at the time of submission
Licencing and Authorisation:
• Maintain in good standing all licences, registrations, and authorisations required to practise employment law, PAGA representative actions, and/or personal injury law in the State of California
• Promptly notify pagaleads.com of any State Bar disciplinary action, suspension, or disbarment affecting any attorney at your firm
• Promptly notify pagaleads.com of any material change in your firm's practice areas, geographic coverage, or intake capacity that may affect your ability to serve leads in purchased verticals
5. TCPA COMPLIANCE AND CONSENT DOCUMENTATION
A. TrustedForm Certificate
Every lead delivered by pagaleads.com is accompanied by a TrustedForm certificate URL generated by ActiveProspect at the moment of form submission. This certificate constitutes an independent third-party record of the consumer's prior express written consent to be contacted by a California-licensed attorney.
Participating Law Firms must:
• Retain the TrustedForm certificate URL for every contact made with a pagaleads.com lead
• Store the certificate as part of firm compliance records for a minimum of 5 years from date of receipt
• Present the certificate in response to any TCPA dispute, regulatory enquiry, or State Bar investigation
• Not contact any lead by automated dialling system, prerecorded message, or SMS without first confirming the TrustedForm certificate is valid and on file
B. Independent TCPA Responsibility
pagaleads.com documents consumer consent at the point of submission. However, each Participating Law Firm is independently and solely responsible for its own TCPA compliance in connection with all outbound contacts made to pagaleads.com leads. pagaleads.com makes no representation that the TrustedForm certificate will constitute a complete defence to any TCPA claim in all circumstances, as compliance depends on the manner and timing of contact by the Participating Law Firm.
C. Consent Revocation
If pagaleads.com receives notification that a consumer has revoked consent to be contacted, we will notify the relevant Participating Law Firm within 24 hours. Upon receipt of such notification, the Participating Law Firm must immediately cease all further contact with that individual and update its internal records accordingly.
6. CALIFORNIA SB 37 COMPLIANCE (EFFECTIVE JANUARY 1, 2026)
This section contains critical compliance obligations under California Senate Bill 37. Non-compliance may expose Participating Law Firms to statutory damages of $5,000 to $100,000 per violation. Read carefully.
A. What SB 37 Requires
California Senate Bill 37 (Business & Professions Code §6153, §6155, §6157, §6157.2, §6158.4, §6158.5, §6158.7, and new §6156.5), effective January 1, 2026, imposes the following requirements on attorney advertising and legal lead generation in California:
• Attorney Identification: every attorney advertisement, including digital advertisements, landing pages, intake funnels, and websites that encourage consumers to contact an attorney, must identify at least one California-licensed attorney by name responsible for the advertisement
• Office Location Disclosure: the advertisement must disclose the city, town, county, or address of at least one bona fide office location of the identified attorney
• No Outcome Guarantees: attorney advertising may not include guarantees, warranties, or predictions regarding the outcome of any legal matter
• No Misleading Claims: advertising may not include false, misleading, or deceptive statements about legal services, outcomes, or attorney qualifications
• Testimonial Disclaimers: testimonials or endorsements must include appropriate disclaimers that results are not guaranteed and may not be representative
• Joint Advertising Compliance (B&P Code §6156.5): where pagaleads.com and a Participating Law Firm engage in joint advertising arrangements, the Participating Law Firm is accountable for the content and compliance of those advertisements
B. Paga Leads's SB 37 Obligations
pagaleads.com complies with SB 37 by:
• Ensuring all consumer-facing advertising and intake funnels use neutral, informational language focused on legal evaluation and options rather than outcome promises
• Not making guarantees, warranties, or predictions about legal outcomes in any advertising or intake content
• Using clear disclaimer language on all intake pages explaining that pagaleads.com is a legal marketing service and not a law firm
• Not operating as or holding itself out as a certified lawyer referral service under B&P Code §6155
• Reviewing all advertising creative for SB 37 compliance prior to deployment
C. Participating Law Firm's SB 37 Obligations
Each Participating Law Firm is independently responsible for its own SB 37 compliance, including:
• Ensuring that any joint advertising arrangement with pagaleads.com identifies at least one California-licensed attorney by name and discloses a bona fide office location
• Providing pagaleads.com with accurate attorney identification and office location information for use in any joint advertising prior to campaign launch
• Auditing existing advertising materials for SB 37 compliance and updating as required
• Ensuring that all communications with prospective clients generated through pagaleads.com leads comply with California Rules of Professional Conduct Rules 7.1 through 7.3 as amended by SB 37
• Not making outcome promises, guarantees, or misleading statements in any follow-up communications to pagaleads.com leads
Participating Law Firms indemnify pagaleads.com against any SB 37 claims, complaints, or penalties arising from the Participating Law Firm's own advertising conduct, communications, or representations made to consumers following lead delivery.
7. PAGA-SPECIFIC COMPLIANCE
Given the specialised nature of PAGA representative actions, the following additional terms apply to PAGA Wage Claim Leads:
• 2024 PAGA Reform Compliance: pagaleads.com qualifies all PAGA leads to confirm the individual has personally experienced a qualifying wage violation consistent with the post-2024 PAGA reform personal experience standing requirement (Labor Code §2699(a)). Participating Law Firms remain independently responsible for confirming standing and all other filing requirements.
• No Guarantee of Representative Standing: pagaleads.com does not represent or warrant that any individual lead will qualify as a PAGA representative plaintiff or aggrieved employee as determined by a court. Lead qualification is based on self-reported information provided by the individual at the time of submission.
• Arbitration Agreements: pagaleads.com does not screen leads for the existence of arbitration agreements. Participating Law Firms are responsible for conducting their own conflict and arbitration agreement review prior to filing any PAGA action.
• Statute of Limitations: pagaleads.com qualifies PAGA leads to confirm alleged violations occurred within the relevant limitations period based on self-reported dates. Participating Law Firms are responsible for conducting independent limitations analysis prior to filing.
• PAGA Representative vs. General Claimant Leads: pagaleads.com may attempt to distinguish between standard aggrieved employee leads and leads pre-qualified as willing to serve as the PAGA representative filer. Pricing and qualification criteria for each tier are set out in the applicable service agreement.
8. PAYMENT TERMS
A. Pricing
Pricing is determined based on lead type (PAGA / Employment Law / Slip & Fall), qualification tier, geographic criteria, and volume. Specific pricing is provided in your service agreement or quote. pagaleads.com reserves the right to adjust pricing for future lead bundles with 30 days written notice to existing clients.
B. Billing
Payment terms are specified in your service agreement. Standard arrangements include:
• Prepayment for a specified number of leads prior to delivery commencing
• Monthly invoicing if a pre-agreed number of leads is required
• Automatic billing via Wire Transfer, Credit Card processing or ACH where agreed
All payments are processed in United States Dollars (USD). Participating Law Firms based outside the United States are responsible for any applicable currency conversion costs or international transaction fees.
C. Pre Payment
No leads will be provided prior to payment.
D. Taxes
You are responsible for all applicable taxes, duties, and government fees associated with your purchase of Services, including any sales tax or GST applicable in your jurisdiction. pagaleads.com will add applicable taxes to invoices where required by law.
9. REFUND AND CREDIT POLICY
A. Lead Credits
pagaleads.com evaluates lead quality issues on a case-by-case basis. Credits or replacement leads will be issued where a lead is demonstrably invalid due to:
• Incorrect, disconnected, or non-functioning phone number verified by your intake team within 48 hours of delivery
• Fraudulent, fake, or clearly nonsensical personal information (e.g. false name, test submission)
• Duplicate delivery of the same lead record to the same firm within the same billing period
• Lead does not meet the agreed-upon vertical qualification criteria (e.g. individual is not in California, or incident falls outside the stated statute of limitations)
• TrustedForm certificate is invalid or fails to load upon verification
B. No Credits for Non-Conversion
pagaleads.com does not issue refunds or credits because a lead did not convert to a signed retainer, did not answer calls, was not interested in legal representation, declined to proceed after initial consultation, or did not result in a case being filed. Lead performance depends on factors outside our control including your intake process, contact timing, and case suitability assessment.
C. Lead Credit (Lead Replacement) Request Process
All credit requests for replacement leads must be submitted within 48 hours of lead delivery to [email protected] with the subject line: Lead Credit Request — [Your Firm Name]. Requests must include:
• The lead record ID or delivery timestamp
• The specific ground for the credit request
• Supporting documentation (call logs, recordings, screenshots, or CRM records)
pagaleads.com will investigate and respond to all credit requests within 5 business days. Valid replacements are provided instantly within the existing lead bundle. We do not issue monetary refunds. Invalid leads are replaced with valid leads.
10. DATA PROTECTION AND PRIVACY
The collection, use, and transfer of personal information in connection with our Services is governed by our Privacy Policy, available at www.pagaleads.com/privacy, which is incorporated into these Terms by reference.
Participating Law Firms acknowledge and agree that:
• All personal information received from pagaleads.com constitutes confidential information and must be handled in accordance with applicable California and federal privacy law, including the CCPA and CPRA
• Personal information received may be used only for evaluating and potentially representing the individual in the disclosed legal matter — not for unrelated marketing, resale, or any other purpose
• Participating Law Firms are independently responsible for their own privacy compliance obligations as a business that receives and processes personal information
• In the event of a data breach affecting personal information received from pagaleads.com, the Participating Law Firm must notify pagaleads.com within 72 hours and cooperate with any resulting notification obligations under California Civil Code §1798.82
• Participating Law Firms must retain TrustedForm certificate URLs for a minimum of 5 years as part of their TCPA compliance records
11. INTELLECTUAL PROPERTY
All content, trademarks, logos, advertising creative, intake funnel designs, qualification frameworks, and materials on the Site or produced by Paga Leads are the property of pagaleads.com or our licensors and are protected by copyright, trademark, and other applicable intellectual property laws.
Participating Law Firms may not reproduce, distribute, modify, create derivative works from, or publicly display any pagaleads.com materials without prior written consent. You may not use our brand name, logo, or trademarks in any advertising or marketing materials without prior written approval.
Lead data delivered to Participating Law Firms is licensed for use solely in connection with the evaluation and potential representation of the relevant individual. No ownership of lead data transfers to the Participating Law Firm.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by California law, pagaleads.com and its officers, directors, employees, agents, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
pagaleads.com's total cumulative liability for any and all claims arising out of or related to these Terms or the Services shall not exceed the total amount paid by you to pagaleads.com in the 12 months immediately preceding the event giving rise to the claim.
pagaleads.com is not liable for:
• Any TCPA claims, complaints, or penalties arising from a Participating Law Firm's contact with leads delivered by pagaleads.com
• Any SB 37 violations or California State Bar complaints arising from a Participating Law Firm's advertising or client communications
• Any failure of a lead to convert to a signed retainer or filed case
• Any third-party CRM, webhook, or integration failures that result in delayed or failed lead delivery
• Any harm arising from a Participating Law Firm's independent assessment of case merit, statute of limitations, or filing decisions
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such limitations are not permitted by applicable law, the above limitations shall apply to the maximum extent permitted.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless pagaleads.com and its officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your use or misuse of the Services or lead data
• Your violation of these Terms or any applicable law or regulation
• Your violation of any California Rules of Professional Conduct
• Your violation of SB 37 or any attorney advertising law
• Your violation of the TCPA, CCPA, or any other consumer protection law in connection with contacts made to pagaleads.com leads
• Any State Bar complaint, regulatory investigation, or civil action arising from your use of pagaleads.com leads or your conduct in representing individuals sourced through our Platform
• Any third-party claims arising from your use or disclosure of lead data
• Your violation of any third-party intellectual property, privacy, or other rights
14. TERMINATION
A. Termination by pagaleads.com
pagaleads.com reserves the right to suspend or terminate your access to the Services immediately, with or without notice, in the following circumstances:
• Failure to pay for leads within agreed payment terms
• Material breach of any provision of these Terms
• Violation of any applicable law, regulation, or California Rules of Professional Conduct
• Any State Bar suspension, disbarment, or disciplinary action affecting the firm
• Misuse of lead data, including resale, redistribution, or use for unauthorised purposes
• Any conduct that may expose pagaleads.com to legal or regulatory liability
• Provision of false or misleading information in connection with your account or lead feedback
B. Termination by the Participating Law Firm
You may terminate your use of the Services at any time by providing written notice to [email protected]. Termination does not entitle you to a refund of any prepaid amounts for leads already delivered or in the delivery queue at the time of notice. If you don't want any more leads, you just stop buying bundles.
C. Effect of Termination
Upon termination:
• Your access to the Services and lead delivery pipeline will cease after the last purchased lead is delivered
• Your obligations regarding data confidentiality, TCPA compliance, TrustedForm certificate retention, and lead data use restrictions survive termination
• Provisions of these Terms that by their nature should survive termination will remain in full force and effect, including Sections 5, 6, 7, 10, 11, 12, 13, and 15
15. GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
A. Governing Law
These Terms and all matters arising from or related to the Services shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
B. Jurisdiction
The parties submit to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California for the resolution of any dispute arising under or in connection with these Terms. pagaleads.com acknowledges that its activities in generating leads from California residents and delivering them to California-licensed attorneys subjects it to California jurisdiction regardless of the location of its principal place of business.
C. Dispute Resolution
Before initiating any formal legal proceedings, the parties agree to attempt in good faith to resolve any dispute through direct negotiation. Either party may initiate this process by delivering written notice of the dispute to the other party. The parties shall have 30 days from the date of that notice to attempt to resolve the dispute through good faith discussion.
If the dispute is not resolved within 30 days, either party may refer the matter to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Los Angeles County, California. Either party may seek injunctive or equitable relief in a court of competent jurisdiction in Los Angeles County where necessary to prevent irreparable harm without first exhausting the dispute resolution process.
D. Class Action Waiver
To the fullest extent permitted by California law, you waive any right to participate in a class action lawsuit or class-wide arbitration against pagaleads.com. Each party agrees that claims shall be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
16. MODIFICATION OF TERMS
pagaleads.com reserves the right to modify these Terms at any time to reflect changes in our Services, applicable law, or regulatory guidance. When we make material changes, we will:
• Update the "Last Updated" date at the top of this document
• Provide at least 30 days written notice to Participating Law Firms by email to the address registered on their account
• Post a prominent notice on our Site
Your continued receipt of leads from pagaleads.com following notification of material changes constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must notify us in writing and cease using the Services before the effective date of the changes.
17. CONFIDENTIALITY
Each party agrees to keep confidential all non-public information received from the other party in connection with these Terms, including pricing, lead qualification methodologies, campaign strategies, and client lists. This obligation survives termination of the Services for a period of 3 years.
This obligation does not apply to information that: (a) is or becomes publicly available through no breach of these Terms; (b) was independently developed by the receiving party; (c) is required to be disclosed by law, court order, or regulatory authority, provided the disclosing party gives the other reasonable prior notice where permitted.
18. FORCE MAJEURE
pagaleads.com shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, government actions, regulatory changes (including changes to Meta advertising policies or California attorney advertising law), failures of third-party service providers (including Meta, TrustedForm, GoHighLevel, or Stripe), or internet infrastructure failures. We will notify you promptly of any force majeure event affecting lead delivery and resume performance as soon as reasonably practicable.
19. GENERAL PROVISIONS
Severability:
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
Entire Agreement:
These Terms, together with our Privacy Policy and any executed service agreement, constitute the entire agreement between pagaleads.com and the Participating Law Firm regarding the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
Waiver:
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorised representative of pagaleads.com.
Assignment:
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. pagaleads.com may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets without restriction. Any attempted assignment in violation of this section is void.
Electronic Communications:
By using the Services, you consent to receive electronic communications from pagaleads.com including notices, service agreements, invoices, lead credits, and compliance updates. You agree that electronic communications satisfy any legal requirement that communications be in writing.
Headings:
Section headings in these Terms are for convenience only and have no legal or contractual effect.
Relationship of the Parties:
